ECS - Engineering and Construction Subcontract

Suitable for any construction-based subcontract between a Contractor and a Subcontractor. It is intended for all sections of the industry, including civil, building, nuclear, oil & gas, etc.

The ECS contract type is the most frequently used subcontract type from the NEC4 family. It is used in high-profile and everyday projects such as infrastructure, buildings, highways and process plants.

The key parties on the NEC4 ECS type of contract are:

Contractor

This is the organisation with which the Subcontractor has a contract, also called the main contractor organisation.

Supervisor

The Supervisor works for the Contractor and checks that the works are constructed following the subcontract.

Subcontractor

This outlines the supplier’s role in the subcontract. The Subcontractor is the main contact person within the supplier organisation to manage the delivery of the subcontracted works.

- Submit the Assessment for the final remaining amount

- Raise changes in scope

- Submit Programme

- Communicate internally for queries with the contract team

- Raise late notices

- Request extension of time

Contractor

- Raise a Contract

- Raise early warnings with delay, cost, and performance implications

- Review and acceptance of the Subcontractor’s design

- Decide on the date of completion

- Instruct the Subcontractor to submit/resubmit quotations

- Accept submitted quotations

- Notify the Subcontractor of Compensation Events

- Raise an assessment against CE

- Review Compensation Events

- Approve extension periods

- Review completion certificates

- Certify final payment for termination

Supervisor

- Communicate with the Subcontractor for contract-related queries

- Raise and notify the Subcontractor of defects in the Subcontract
